Sales Conditions –Taylor & Walker - Miami

Article 1. Definitions

Withdrawal period
The period during which the consumer may withdraw from the distance sales contract.

Consumer
A natural person who acts for purposes outside their business, commercial, or professional activity and enters into a distance sales contract with the seller.

Long-term contract
A distance sales contract for the regular supply of goods or services over a specified period.

Right of withdrawal
The consumer’s right to terminate the distance sales contract within the withdrawal period.

Seller
A natural or legal person who offers goods or services to consumers through distance selling.

Distance sales contract
A contract concluded between the seller and the consumer using means of distance communication.

CESOP
The Central Electronic System of Payment Information introduced by the European Union to monitor transaction data from payment service providers.

Article 3. Scope

These sales conditions apply to all offers made by the seller and to all distance sales contracts concluded between the seller and the consumer.
These conditions are provided to the consumer electronically or by other means before the contract is concluded.

Article 4. Offer Details

All offers are non-binding.
The seller reserves the right to modify or withdraw an offer.
Each offer states the total price, including shipping costs, customs duties, and any other additional charges.

Article 5. Formation of the Contract

The contract is concluded when the consumer accepts the offer and meets the required conditions.
After acceptance, the seller will send an order confirmation email.

Article 6. Right of Withdrawal

The consumer may withdraw from the contract within 14 days from the date of receipt of the goods, without giving any reason.
The cost of returning the goods is borne by the consumer.

Article 7. Refund

After receiving the withdrawal notice, the seller will issue a refund within 14 days, provided the goods are returned in their original condition.

Article 8. Customs and Tax Regulations

The buyer is responsible for complying with all laws, customs duties, taxes, and other costs related to import.
The seller is not the official importer.

Article 9. CESOP Compliance

From 2024, EU regulations require payment service providers to report transaction data to CESOP.
This may affect how payment information is monitored.

Article 10. Conformity and Warranty

The seller guarantees that all goods comply with the contract and applicable laws.
Claims regarding defects must be submitted in writing within 14 days after receiving the goods.

Article 11. Delivery

Unless otherwise agreed, orders will be delivered within 30 days.
If delays occur, the seller will inform the consumer within 14 days from the order date.

Article 12. Complaints

Complaints must be submitted in writing within 7 days after the issue is discovered.
The seller will respond within 14 days.
If additional time is required, the seller will notify the consumer.

Article 13. Disputes

These sales conditions are governed by the laws of the United States.
Disputes will be resolved through consultation whenever possible.
If no resolution is reached, disputes will be submitted to the competent courts in the United States.

Article 14. Money back guarantee

Please note that this does not necessarily entitle the customer to a full refund of the purchase amount. In situations involving customer dissatisfaction, refunds are typically partial.
